The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Antitrust Trial

Michael Jeffrey Jordan, as he cordially introduced himself in a federal courtroom on Friday, stated that his drive to win and novelty within the sport emboldened his push for 23XI Racing to confront Nascar over alleged violations of antitrust rules.

Team Investment and a Competitive Drive

Jordan shared financial and corporate details of his racing venture, revealing he invested $40m of his own funds into the Nascar Cup series team launched with partner Polk and driver Hamlin.

“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I believed I could take on Nascar as a whole. I felt as far as the sport it needed to be looked at from a different view.”

The Core Dispute: Franchise System and Contract Pressure

At issue is the expiration of a 2016 deal where Nascar provided each team a franchise. This system mirrors other professional sports with independent franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.

Jordan testified for about sixty minutes and left the court to pandemonium, with onlookers and reporters clamoring for a glimpse or a photo of the sports legend.

Spearheading the Fight

23XI Racing is leading the full-court press along with another racing team for Nascar to overhaul a business model Jordan said is unlawful to maintain excessive control.

For Jordan and and a fellow team representative, who testified before Jordan, are details from September 2024. Gibbs described a frantic and emotional six hours where the racing circuit informed teams they must sign a contract extension. The document consists of 112 pages detailing team compensation and a guaranteed entry in Nascar-sponsored races.

Choosing Litigation

Jordan explained that his team and its ally concluded their only feasible option was to refuse a signature that 112-page package and litigate the matter. The other 13 organizations signed the agreement.

The team owners approached Nascar about possible changes or extension options. Nascar refused to engage, Jordan said.

The Bottom Line: Victory

But in the end, the pushback against what he saw as a financially unsustainable model was mostly about the familiar goal for Jordan: Success.

“Hamlin persuaded me adding a third car boosted our odds of winning,” he said, sharing that he bought a third charter late in 2024 for $28 million amid the legal dispute. “So I took the plunge.”

Heather Gibbs’ Testimony

Gibbs described her request for permanent charters, which she said a written letter to Nascar. She said the pressure of the contract signing demand was problematic.

She said, the team founder first tried to call and talk Nascar out of forcing signatures, but Nascar’s leader refused the appeal.

“Please don’t force this on us,” Heather Gibbs said was the message to Nascar’s leadership. She said France replied, “Whether I have 20 charters, I have 20. If there are 30, I have 30.”
